NC REPUBLICANS THREATEN HB562
  


Although most NC House Republicans have at least reasonable gun-rights voting records, it is disappointing to see them leaning the wrong direction on HB562 in the face of pressure from the North Carolina Sheriff's Association (NCSA), and anti-gun groups that are funded by wealthy out-of-staters like Michael Bloomberg. GRNC and other pro-Second Amendment groups fully support the repeal of our state's Jim Crow Pistol Purchase Permit system (PPP), while the NCSA does not. Although the law-abiding people of North Carolina stand to gain greatly from the elimination of this antiquated and embarrassing PPP system, the NCSA stands to lose a lot. . . of power.


The NCSA Position is All about Power

And that's why, over the years, NCSA’s objections to purchase permit reform have been a moving target.

First, NCSA insisted that sheriffs “know” the people of their counties and “know” who should or should not have a handgun. In truth, the increasing urbanization of the state makes that impossible and by insider reports, prior to issuing permits most sheriffs run only the NICS check which NCSA now claims is inadequate.

When NCSA claimed our reporting to NICS is inadequate, sponsors included within HB 562 measures to require reporting of disqualified persons to NICS within 48 hours, and to require fingerprinting of certain disqualifying misdemeanors (resulting in reporting to NICS). GRNC even conceded to allowing a full six years for the law to sunset in order to ensure adequate NICS reporting, but even that doesn’t satisfy NCSA executive director Eddie Caldwell.

 

Most absurd is the argument Caldwell has been shopping to member sheriffs that the bill would be an intrusion on the power of “The High Sheriff” vis a vis the federal government since, after all, the FBI could shut down NICS and stop gun sales. The not-so-tiny flaw in this argument is that under N.C.G.S. 14-404(a)(1), sheriffs are required to do a NICS check before issuing a pistol purchase permit.

 

Can Representative McNeill be Trusted?

After negotiating and approving of the PPP repeal language currently in HB562, "six-year sunset" provision and all, Rep. McNeill now intends to offer a floor amendment to remove the repeal of the PPP all together. If Rep. McNeill can’t be trusted to uphold an agreement he made, when can he be trusted?


Inform Your Representatives

Clearly, your representatives need to be reminded (again!) who actually votes in primaries and general elections (hint: your county has but one sheriff). Below, see how you can contact your the NC House Republicans to remind them who gave them the supermajority they currently enjoy, and let them know that you expect them to fight against Jim Crow, not prolong it at the NCSA's behest. Also, find the details about tomorrow's (Monday evening's) House floor session.     Remind your representative and Rep. McNeill that it is gun owners like you who sent him/her to Raleigh. Let him know that you are fully aware that the NCSA's arguments against repealing the Jim Crow-era Pistol purchase Permit system don't hold water. The representatives of the people are elected by the people, not the Sheriff's Association, and they should represent you as such. Failing to move HB562, including the repeal of the antiquated PPP, will absolutely have political consequences.

Dear Representative:

I am writing to express my regret over the fact that many House Republicans are finding that HB 562 places them between Second Amendment organizations which support the reform of our Jim Crow-era pistol purchase permit law, and the North Carolina Sheriffs’ Association, which does not. I was particularly disappointed to hear that Representative Allen McNeill plans to offer a floor amendment to remove the purchase permit reform, since it was Rep. McNeill who negotiated and agreed to the present language in the first place. McNeill’s flip-flop sounds a lot like John Kerry saying, “I actually voted for [the Iraq war]… before I voted against it.” I truly hope that you are not following Rep. McNeill's lead on this. 

The fact is, the NCSA's arguments agains the repeal of the Pistol Purchase Permit system don't hold water, and this is why they are a moving target. First, NCSA insisted that sheriffs “know” the people of their counties and “know” who should or should not have a handgun. In truth, the increasing urbanization of the state makes that impossible and by insider reports, prior to issuing permits most sheriffs run only the NICS check which NCSA now claims is inadequate. When NCSA claimed our reporting to NICS is inadequate, sponsors added measures to HB 562 to require reporting of disqualified persons to NICS within 48 hours, and to require fingerprinting of certain disqualifying misdemeanors (resulting in reporting to NICS). The NCSA has even been shopping the idea to its members that the bill would be an intrusion on the power of “The High Sheriff” vis a vis the federal government since, after all, the FBI could shut down NICS and stop gun sales. The not-so-tiny flaw in this argument is that under N.C.G.S. 14-404(a)(1), sheriffs are required to do a NICS check before issuing a pistol purchase permit. Finally, a provision has been added to HB562 to allow a full six years for the law to sunset in order to ensure adequate NICS reporting, but even that doesn’t satisfy NCSA executive director Eddie Caldwell. The goal posts are constantly moving, which is a good indication that the reasons for the NCSA's resistance is not at all what is being stated by the organization.

Representative, based on North Carolina’s 2014 population of 9.944 million and Gallup’s 2014 poll indicating that 42% of American households contain guns, a logical estimate would posit about 4.1 million North Carolina gun owners. Meanwhile, the State Bureau of Investigation reports 429,000 current concealed handgun permit-holders, of which GRNC has data-matched 299,000 with the State Board of Election voter database. I and all of these other pro-gun voters watch what are Representatives are up to, and we vote accordingly. By contrast, there are 100 county sheriffs. As saying goes, “You do the math.” 

If my representative in Raleigh does not vote to support the Second Amendment, I am not averse to supporting a primary opponent, nor am I averse to abstaining from voting in my State House race in November, should it be come to that. I insist that you support HB 562 with your vote, and vote against any amendment that would weaken it, particularly an amendment that would remove the repeal of the Jim Crow-era Pistol Purchase Permit.
