Dear Sheriff Schatzman:

As the state’s predominant gun rights organization, Grass Roots North Carolina has been central to passing and improving the state’s concealed handgun permit law. As a service to members, GRNC also monitors administration of the concealed handgun permit application process.

A member recently advised us that your office requires employment information, including the name, address, phone number of applicants’ employers. Indeed, the form is prominently displayed at:

This requirement is a clear and direct violation of N.C. Gen. Stat. § 14-415.14, which includes in part:

“The permit application shall be in triplicate, in a form to be prescribed by the Administrative Office of the Courts, and shall include the following information with regard to the applicant: name, address, physical description, signature, date of birth, social security number, military status, law enforcement status, and the drivers license number or State identification card number of the applicant if used for identification in applying for the “permit".

Please note that nothing in the statute requires – or allows – collection of employment data for concealed handgun permit applicants. Accordingly, to prevent further action, I strongly urge you to immediately: (1) Remove the form from your web site; (2) Desist from collecting employment data from concealed handgun permit applicants; and (3) Notify Grass Roots North Carolina of your compliance with Article 54B of the North Carolina General Statutes.
