Demand Hearing on 'Firearm Restoration'
 

 

HB 7 has passed House twice, but languishes in Senate…


House Bill 7, “Amend Firearm Restoration Law,” would restore firearm rights to a small number of people who had their firearm rights removed as a result of a 1995 change in the law.

Prior to December 1, 1995 a person convicted of a felony lost their right to own firearms (handguns only). After five years, their firearms rights were automatically restored.  Even during the five years where their rights were restricted, they were still allowed to have a firearm in their home or place of business.

Effective December 1, 1995 all felons who had their rights restored lost them as a result of the new law, which changed the five years to twenty, only allowed one non-violent felony, and after twenty years the individual could pay $200.00 and apply to a Judge for restoration of their right to own firearms. The Judge would make the final decision.

In 2004, the law was again changed to take away the right to possess any firearm, even in the home. The 1995 law stated that it applied to ‘all felonies committed before, on or after December 1, 1995”. This effectively took away the right to possess a firearm from all people whose rights were restored. HB 7 would return firearms rights to those whose right to possess firearms was revoked only as a result of the implementation of the new law. This bill does not change current law, but merely restores firearm rights to those from which they were unfairly taken.

 


IMMEDIATE ACTION REQUIRED!
 

 

Although the bill has twice passed the NC House (the last time overwhelmingly by 105-4), the Senate has been unwilling to give it a hearing. Meanwhile, the General Assembly plans to adjourn in July. Without action soon, the bill will again die.

Senate Judiciary II Committee Members:

I strongly urge your committee to rectify a wrong perpetrated against citizens in past sessions of the General Assembly by giving a prompt hearing to House Bill 7 (“Amend Firearm Restoration Law”).
