STOP THE BATFE'S 'MULTIPLE SALES' REPORTING
 


The BATFE is Unlawfully Collecting Data on Gun Owners

You may or may not be aware that the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) is attempting to extend the period of time for which extra reporting is required when a citizen purchases more than one rifle, of a certain type, within a five-day period. The fact that this information is being collected in the first place is unacceptable, and should cease immediately. However, contrary to what is right and reasonable, the BATFE is contemplating extending the period of time for which this extra data collection would be conducted. This data collection is unlawful, it lacks any practical purpose, and it is an undue burden on those gun dealers tasked with collecting, tracking and filing the forms. Currently, this practice is being forced on gun dealers and gun owners in just a few states (Arizona, California, New Mexico and Texas), but we all know how that goes. If this practice is not ended, and soon, it’s just a matter of time before you, right here in North Carolina, will be officially reported to the BATFE if you ever decide to purchase more than one rifle within a five day period. The time to stop this is now!

Fortunately, there is something you can do to help stop this. The time period for which comments on this subject can be submitted to the BATFE has been extended. You are strongly encouraged to join other citizens and submit comments on this topic. Let the BATFE know that what they are doing is not only impractical, it’s illegal. Below, you’ll find what you need so you can quickly and easily comment on this critical matter. Please help to nip this blossoming infringement in the bud.

I am writing to insist that the data collection requirement that is currently being imposed on federally licensed firearms dealers (FFLs) in certain states, for the “multiple sales” of certain rifles, be ended. Requiring the collection of this information is unlawful, impractical and it is an undue burden on those tasked with collecting the data.

The “multiple sales” data that the BATFE is demanding FFLs collect in Arizona, California, New Mexico and Texas is not information that FFLS are required by law to keep. Therefore, it is not within the BATFE’s authority to demand that this information be collected, tracked and stored.

The “multiple sales” data collection has no practical purpose because it seeks to report on purchasers who have already passed the NICS check. Reporting on law-abiding citizens engaging in lawful commerce is of no particular use.

The agency has also underestimated the amount of time and attention that FFLs must lend to this data collection. Aside from the form itself, the information must be recorded in such a way as to allow the FFL to keep track of each sale, and also the time period between each sale, in order to determine if a “multiple sale” form must actually be filed. The tedious and time-consuming nature of this is easily recognizable, and foists an unrealistic burden upon FFLs. 

Clearly, the “multiple sales” data collection currently required of FFLs in certain states is unlawful, impractical, and creates an undue burden on those engaging in lawful activity. I must insist that the BATFE end this practice as soon as possible. Thank you for your consideration of my comments on this important matter.
