Schumer-Lautenberg Magazine Ban Update

Details are emerging regarding the magazine ban recently proposed by Sens. Chuck Schumer (D-NY) and Frank Lautenberg (D-NJ) as an amendment to the "Cybersecurity Act" currently being considered by the US Senate
In many respects the proposed ban is even more draconian than the prior Clinton ban that ended in 2004. Specific features that gun owners should be aware of include:
  • It places on gun owners the burden of proof that standard magazines with capacities > 10 rounds were manufactured pre-ban.

  • It specifically precludes loaning or sharing of pre-ban standard capacity magazines.

  • It provides for fines and up to 10 years in prison for violations: twice the sentence time specified by the Clinton ban.

This law was clearly drafted to punish law-abiding gun-owners and to push the armed citizenry into use of less than optimally-effective weapons for defense of themselves and their families. The Second Amendment protects arms to be used by an effective militia. Making available only obsolete and reduced-capacity weapons clearly violates this intent and must be stopped!

Where Do NC Senators Stand?

Senator Richard Burr (R-NC, ****) has been a champion of gun-rights but also is one of the original sponsors of the “Cybersecurity Act”. Now that this Act is being used as host for the parasitic magazine ban, he has clear conflicted interest in the issue. We need him to understand that failure to pass his “Cybersecurity Act” is better than approval of one with a poisonous, anti-gun amendment.

Our second US Senator, Kay Hagan (D-NC, 0-star) pays lip service to Second Amendment rights, but her actions betray her. For example, she recently failed to sign onto a pledge to vote against ratification of the UN Small Arms Treaty that would have exposed our rights to international infringement. She has an opportunity now to redeem herself by refusing to support this anti-freedom amendment.

As a North Carolina gun owner I am outraged and insulted by the proposal to limit access of law-abiding citizens to only reduced-capacity magazines for modern defensive firearms.

This law, submitted as S.A. 2575 to the “Cybersecurity Act” that you sponsored, makes it clear that some US Senators believe that law-abiding North Carolinians should only be trusted to defend themselves and families with obsolete weapons.

As your constituent I want you to understand that failure to pass the “Cybersecurity Act” would be better than passing it with a clearly anti-freedom amendment.

In  the past you have claimed to support gun rights. Your actions, however, have often been inconsistent with this stated position. For example, your lack of signing the pledge to not support ratification of the UN Small Arms Treaty was particularly troubling.

The  anti-gun amendment currently at issue provides you with an opportunity to clearly demonstrate by your actions that you support the Second Amendment. Your action on this issue will be remembered during your next election.
