Return of the Rapist Protection Act!

SB 664 is
the reincarnation of the Rapist Protection Act which
anti-gunners attempted to enact back in 2001. The bill
at that time came from the House in the guise of HB
320. Research has shown that mandatory storage laws
lead to increases in rapes, murders and aggravated
assaults. This is due to an increased sense of safety
“on the job” experienced by the criminal element. Who
do you wish to feel safer in your home, you or the
criminals?

Among the other features of SB 664, like HB 320 are
these:
* Changes existing law to apply to firearms misuse by
minors who do not reside in the residence of the gun
owner, and who may not even be under his or her
control.
* While current law only applies to the owner of a
firearm which is misused by a minor, the bill includes
even people who do not “own or possess” the firearm.
It could even be applied to a homeowner whose guest
brings a gun into the home.
* While current law exposes gun owners to prosecution
if they leave a firearm “in a condition that the
firearm can be discharged,” the bill removes this
provision, meaning storage requirements would apply
not only to unloaded firearms, but even to parts of
firearms which could theoretically be assembled.
* Current law applies to cases in which minors display
firearms in a “careless, angry, or threatening
manner,” who “cause personal injury or death with it
not in self defense,” or who use it “in the commission
of a crime.” By contrast, this would extend to anyone
whose gun is taken into “public,” even if the gun is
being used responsibly.
* Under a new section the only way lawful gun owners
could protect themselves from prosecution is to store
firearms “unloaded in a locked box or container, with
the ammunition stored separately or “kept unloaded and
equipped with a tamper-resistant mechanical lock or
other safety device properly engaged so as to render
the weapon inoperable by any person other than the
owner or other lawfully authorized user.” As thousands
of people who have used guns for self-protection can
attest, a gun which is locked away, unloaded and with
the ammunition stored separately is useless for
self-defense. Moreover, because several brands of
trigger locks have been recalled due to defects which
permit unauthorized access to the firearm, no clear
definition exists of what constitutes a
“tamper-resistant” device.

Dear Senator:
Research has shown that mandatory gun storage laws
lead to increases in rape, murder and aggravated
assault because criminals know that guns are locked
away. So SB 664 will do more to protect and enable
rapists than to provide any false sense of safety in
the home.
It is vital that you do everything in your power to
stop this latest version of “The Rapist Protection
Act.” Stop the madness, protect law abiding citizens,
not rapists.
