Overbroad HB 47 Passes Judiciary I Committee

HB 47, "Violate Order/Possess Deadly Weapon Felony," has passed the House Judiciary I committee and is now headed to the House Appropriations I committee. Act now.

HB 47 is a bill to make it a felony for a defendant under a domestic violence restraining order to possess a deadly weapon while violating said Domestic Voilence restraining order. GRNC does not support domestic violence abusers subject to restraining orders that stalk their victims while carrying deadly weapons. However, in the current language "possession" and "deadly weapon" can be broadly interpreted. GRNC believes we need to oppose the bill in its current form.

Dear Representative:

Domestic violence abusers under 50B restraining orders should not violate the restraining order, let alone stalk their victims while carrying deadly weapons. However, HB 47 is written with language that is too broad. The definitions of deadly weapon and possession need substantial redefinition before it might become acceptable.
